Three laws:
- in the European Union, anonymous and pseudonymous works protected for 70 years after the date of publication (Directive 93/98/EEC)
- in Japan, anonymous and pseudonymous works protected for 70 years after the date of publication (Wikipedia's Japan copyright law) and pictures published before 1969 protected for 10 years only (to be checked)
- in the USA, anything published before March 1, 1989 with no copyright notice ("©", "Copyright" or "Copr.") is in the public domain
Rule of the shorter term:
- applied by the EU and Japan: copyright protection ends when the copyright expires in the originating country; after 70 years it has expired in any case
Fair use:
- applied by the USA only: fair use is allowed
In short, we can consider public domain for the laws of all relevant countries all the documents dated 1936 and earlier. We can also consider public domain for the laws of all relevant countries all the Japanese documents dated 1956 and earlier. See this document about the US expiry dates.
