In this page and others there are some ads by Nesster and this comment is relevant. --Not sure how copyright stands on recent advertising... this doesn't fit in any of the Public Domain categories, and is it Nesster's to licence under Creative Commons? -- Should those be under "fair use"? Questions of intellectual-property law are a big hairball (remember that our contributors and visitors are from many countries) and the general wiki approach has been "we do our best but if someone squawks we'll change it." You're making an accurate point that as I understand US law, you don't get a copyright for scanning an existing work—it's still the original creator's copyright. But I've uploaded ad scans and it usually hasn't occurred to me to revise the CC licensing which is the default I have set in my Flickr account. Then page editors just pass that through to the image template field without thinking too much about it. In practice it doesn't matter a lot as a great majority of pre-1978 ads already have fallen into public domain because 1) no © symbol was included and/or 2) copyright was not renewed at the end of the original 28-year term. Thus "fair use" is not exactly correct either. Even beyond that, somehow Google Books has 30 years of Popular Photography available in full text. The legal basis of that is curious but I'm sure they've got a thick slab of lawyerly advice to back it up.--Vox (talk) 01:17, 22 July 2021 (UTC)
